Terms & Conditions

Welcome to Marpe Wellbeing. Marpe Wellbeing is the trading name of Marpe Kalos Limited (Company No. 12561490) a company incorporated in England and Wales whose registered office is at 49 Station Road, Polegate BN26 6EA. 


Marpe Wellbeing is an online platform operating on web and app. Marpe Wellbeing provides a platform where individuals (clients) may select and book remote video appointments with self-employed therapists (counsellors, psychotherapists and psychologists).


You should please read these terms carefully. By using the Marpe Wellbeing Web and App Platforms and/or using its service agree that you have read, understood and agreed to these terms (each as amended from time to time).


If you do not agree to these Terms you must not use the Marpe Wellbeing Web and App platforms or use its services. By using Marpe Wellbeing web and app platforms, you are agreeing to comply and be bound by the following terms and conditions:


Background & Liability 

  • Marpe Wellbeing is an app and web-based platform that provides clients with a platform to browse a selection of self-employed therapists who can provide them with therapy or counselling service. 


  • Marpe Wellbeing provides a selection of therapists who have been verified by Marpe Wellbeing team. Verification includes but are not limited to: interview, checking their membership with regulatory bodies and DBS checks.


  • The Client is able to browse through these self- employed therapists and book a paid session with them on the Marpe Wellbeing App. 


  • The Client acknowledges that Marpe Wellbeing does not supervise and/or control the actions of any therapist. Nothing in this Agreement shall in any way constitute any therapist as the employee or worker of Marpe Wellbeing. The Client’s relationship will be directly with their selected therapist who will be solely responsible for the services that they provide to you.


  • Marpe Wellbeing shall not be responsible for supervising, monitoring or directing the therapist whilst providing a service to a client and that accordingly, only the Client is in a position to assess and insure against risks in respect of or during or arising out of the period for which the therapist is performing the therapist services. 


  • The Client acknowledges that Marpe Wellbeing is not an employment agency for the purposes of the Conduct Regulations and is instead a medium through which clients find healthcare professionals for themselves.


  • The Client and Therapists agrees that Marpe Wellbeing will not be liable for any loss or damage caused by a virus, distributed denial-of-service attack, or other technologically harmful material that may infect or affect your computer equipment, computer programs, data or other proprietary material due to your use of our site and/or apps or to your downloading of any content on it, or on any website and/or app linked to it.


  • Marpe Wellbeing shall not be liable for any Losses arising from: (a) any failure to provide the services of the therapist for all or part of the term of this Agreement; (b) the negligent, wrongful, dishonest or fraudulent acts or omissions or misrepresentations of the therapist, including, without limitation, any lack of skill of any Healthcare Professional or (c) the theft, destruction, deletion or damage of or to any data, computer systems or materials by any Healthcare Professional.


The Client agrees to the following:

The Client acknowledges that they must be over 13 years of age to use this app and if between 13 and 16 years of age, they must have permission from guardian or parent to use Marpe Wellbeing App/ Services unless they have compelling strong reason why they cannot inform them.


The Client acknowledges that if between age 13 and 16 years of age, it is recommended to read the terms set out in this terms and condition with a trusted adult.


The Client acknowledges that if between age 13 and 16 years of age, at the start of any therapy session, the therapist will seek permission to proceed from the client’s parent or guardian where possible.


The Client agrees that all information provided by themselves is true, accurate and up to date. A breach of this could compromise the services rendered from the therapist.


The Client acknowledges that Marpe Wellbeing Web/App may not meet their requirements or that their video conference session will be uninterrupted, timely or error-free. If any defects arise, these will be corrected as soon as practicable.

The Client acknowledges that therapist will be solely responsible for providing you with their professional opinion and advice and accordingly we disclaim any liability in relation to any advice or opinion or service provided to you by the practitioner.


The Client acknowledges that Marpe Wellbeing is not liable for their mobile data use.
 

Bookings, Payments & Appointments

The Clients and Therapists agree to the following:  

  • Marpe Wellbeing service is not for crises or emergency life threatening appointments. Should you require immediate help, please call 999 or attend your nearest accident & emergency services.


  • The Client payment for therapy sessions will be taken at the time of booking. Please therefore have your payment card details at hand.


  • The Client pays for their booked therapy session at point of booking on the Marpe Wellbeing web/app based platform only and never directly to the therapist.


  • Any discussion or arrangement of payment of therapy sessions between the client and therapist during therapy sessions or outside of sessions on Marpe Wellbeing web/app platform is a breach of contract and Marpe Wellbeing has the right to remove and restrict therapist and client further use of Marpe Wellbeing platforms should this occurs.


  • The Client shall ensure that payment to the therapist is made only as per booking and payment procedures on the Marpe Wellbeing App. Any action that involves complete or partial payment in any other way shall be a breach of this Agreement.


  • Marpe Wellbeing is not bound to any arrangements or payments made related to therapy sessions in breach of contract. 


  • Sessions will last for either 30 minutes or 50 minutes and is determined by the client’s selection at time of booking.


  • If for any reason you have not entered the virtual waiting room within 15 minutes of your scheduled appointment time for a 30 minute appointment or within 25 minutes of your scheduled appointment time for a 50 minute appointment, the session will automatically end and will be deemed as a missed session. There will be no refund should this occur.


Cancellations & Refund Policy 

The Clients and Therapists agree to the following:  

  • There is no refund for any appointment cancelled with less than 48 hours’ notice; this is also the case for any missed sessions.


  • A refund will be arranged if cancellation is done with at least 48 hours before scheduled appointment time.


  • In exceptional circumstances a therapist may have to cancel your appointment – if this occurs you will receive a full refund for that session.  


  • Sessions booked with less than 48 hours’ notice cannot be refunded if cancelled.  


  • Marpe Wellbeing reserves the right to offer refunds, discounts or other consideration in certain circumstances at its sole discretion. Please note that each circumstance is unique and election to make such an offer in one instance does not create the obligation to do so in another circumstance.


  • Please note that if you join any session under the influence of drugs or alcohol, or become abusive, insulting, disruptive or act in an unreasonable manner during the session the therapist will be entitled to terminate the session and you will remain liable for the payment of the session


Complaints

The Clients and Therapists agree to the following:  

  • Marpe Wellbeing shall not be responsible for  disputes between the Client and a therapist and shall not be responsible for the quality of the therapist service that they provide. 


  • However, we do ask that the client shall notify Marpe Wellbeing immediately if it is dissatisfied with the performance by the Healthcare Professional. This can be done by email : hello@marpewellbeing.uk


  • For official complaints the clients agrees to contact the therapist regulatory body should they wish to proceed to an official complaint.


  • The Marpe Wellbeing Service Fee do not indicate acceptance of any liability for the therapist acts or omissions. 


For Therapists

  • Marpe Wellbeing shall not be responsible for any loss relating to any therapist not complying with any legal or tax requirements when acting as an intermediary. Marpe Wellbeing encourages the therapist to carry out its own due diligence with regard to their taxes.


  • Any responsibility of the therapists in respect of deductions for income tax and/or national insurance and accounting to HMRC for the same shall be the responsibility of the therapist and the therapist agrees to perform those responsibilities.


  • The therapist  shall indemnify and keep indemnified Marpe wellbeing against any losses incurred by Marpe Wellbeing arising out of any breach of this agreement by the therapist.


  • Therapists agree to adhere to their Code of Ethics of their regulatory bodies.


  • Therapists agree to have in force appropriate professional liability insurance.


  • Marpe Wellbeing reserves the right to terminate your registration on its web/app platform if there is evidence of unprofessional behaviour, breach of contract, poor ratings (three stars out of five) from client or complaint. 


  • Marpe wellbeing reserves the right to define poor ratings and this may be changed at any time.


  • Marpe Wellbeing reserves the right to deduct from your payments should there be evidence of lateness to client appointments. 


  • The Therapist agrees that unprofessional behaviour including repeatedly cancelling appointments within 48 hours, probity issues and lateness to client appointments count as unprofessional behaviour and may lead to termination of registration on all of Marpe Wellbeing’s platforms.


Website and/or Apps content: 

The Clients and Therapists agree to the following:  

  • Neither we nor any third parties provide any warranty or guarantee as to the accuracy, timeliness, performance, completeness or suitability of the information and materials found or offered on this website and/or apps for any particular purpose. We acknowledge that such information and materials may contain inaccuracies or errors and we expressly exclude liability for any such inaccuracies or errors to the fullest extent of the law. 


  • Your use of any information or materials on this website is entirely at your own risk, for which we shall not be liable. It shall be your own responsibility to ensure that any products, services or information available through this website and/or our apps meet your specific requirements. 


  • The site and/or apps content is not intended to amount to advice on which you should rely or a tool for diagnosis. You must obtain professional or specialist advice before taking, or refraining from, any action on the basis of the free content on our site.


  • We assume no responsibility for the content of websites and apps linked on our site and/or our apps. Such links should not be interpreted as endorsement by us of those linked websites and apps. We will not be liable for any loss or damage that may arise from your use of them.


  • This site and our apps contain material which is owned by or licensed to us. This material includes, but is not limited to, the design, layout, look, appearance and graphics. Reproduction is prohibited.


Accessing our site

The Clients and Therapists agree to the following:  

  • We do not guarantee that our site and our apps, or any content on them, will always be available or be uninterrupted. Access to our site and/or apps is permitted on a temporary basis. We may suspend, withdraw, discontinue or change all or any part of our site and/or our apps without notice. We will not be liable to you if for any reason our site and/or apps is unavailable at any time.


  • You are responsible for making all arrangements necessary for you to have access to our site and/or apps. You are also responsible for ensuring that all persons who access our site and/or apps through your internet connection are aware of these terms of use and other applicable terms and conditions, and that they comply with them.


  • We do not guarantee that our site and/or apps will be secure or free from bugs or viruses. You are responsible for configuring your information technology, computer programmes and platform in order to access our site and/or apps. You should use your own virus protection software.


Linking to our site

The Clients and Therapists agree to the following:  

 

  • You agree to use the Marpe Wellbeing web/app platform and services only for lawful purposes and in a way which does not infringe the rights of anyone else or restrict or inhibit anyone else's use of the Marpe Wellbeing. You are permitted to download and print content from Marpe Wellbeing web/app solely for your personal use. 


  • Marpe Wellbeing web/app content must not be copied or reproduced, modified, redistributed, used or otherwise dealt with for any reason without Marpe Wellbeing web/app express written permission. 


  • You are not entitled to use the content of the Marpe Wellbeing web/app for commercial exploitation in any circumstances. 


  • By using the Marpe Wellbeing web/app and/or the service, you agree not to:  

• Use the Marpe Wellbeing web/app or service, or any information contained therein in any way that is abusive, threatening, obscene, defamatory, libellous, or racially, sexually, religiously, or otherwise objectionable and offensive;


• Use the Marpe Wellbeing web/app platform or service for any unlawful purpose or for the promotion of illegal activities;


• Attempt to, or harass, abuse or harm another person or group;  use another person's User Account without permission; provide false or inaccurate information when registering a User Account, using the Marpe Wellbeing web/app Service or communicating with other users; 


  • You may link to our site and/or apps, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it. You must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists. Our site and/or apps must not be framed on any other site or app. 


  • We reserve the right to withdraw linking permission without notice. If you wish to make any use of content on our site and/or apps other than that set out above, please contact us in the first instance.


Applicable law

The Clients and Therapists agree to the following:  

  • Your use of this website and/or apps and any dispute arising out of such use of the website and/or apps is subject to the laws of England.
